Bode Miller is off the hook following a traffic stop in Idaho that saw the former Olympic skier charged with misdemeanor drug possession and paraphernalia charges.
According to TMZ, who broke the news on Thursday, Miller’s attorney, Jeromy Stafford, tells the outlet that Fremont County Prosecutor Lindsey Blake has agreed to dismiss the charges stemming from Miller’s June 6 arrest.

In a statement to TMZ, Blake said that while the deputy had “sufficient probable cause” to arrest Miller, after receiving new information in relation to Miller’s arrest, the prosecution determined it was “in the interest of justice” to dismiss Miller’s misdemeanor charges.
“I can confirm our office is dismissing the misdemeanor charges against Mr. Miller. Although the deputy had sufficient probable cause to arrest Mr. Miller at the beginning of June, we recently received information which resulted in our office determining it is in the interest of justice to dismiss Mr. Miller’s misdemeanor charges,” the statement reads. “I will not be discussing the specifics of this recent information due to it being related to another active case.”

The decision comes after Miller, who pled not guilty following the June 6 arrest and was released after posting a $5,000 cash bond, was found with psychedelic mushrooms during the stop, per court records obtained by TMZ. Miller, who was set to appear in court July 29, later claimed he believed authorities were referring to marijuana and a pipe found in the vehicle, which he said belonged to a passenger.

According to Stafford, no drugs were physically found on Miller, and he claims the passenger has since taken responsibility for both the weed and the psychedelic mushrooms.
The retired athlete’s arrest came just days ahead of the eight-year anniversary of his daughter, Emeline “Emmy” Miller’s death. Emmy was 19 months old when she tragically drowned in a neighbor’s swimming pool in June 2018.

“We are beyond devastated. Our baby girl, Emmy, passed away yesterday. Never in a million years did we think we would experience a pain like this. Her love, her light, her spirit will never be forgotten,” Miller — who shared Emmy with wife Morgan Beck — wrote in a statement shared on Instagram on June 11, 2018. “Our little girl loved life and lived it to it’s [sic] fullest everyday. Our family respectfully requests privacy during this painful time.”

In addition to Emeline, the couple share five children: Nash, 11, Easton, 7, twin boys Asher and Aksel, 6, and Scarlet, 4.
